Brick Partners (“Brick Partners,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit www.thebrickpartners.com (the “Website”), communicate with us, or use our services (collectively, the “Services”). It is incorporated into and forms part of our Terms and Conditions. By using the Website or Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Website or Services.
1. Who We Are and Our Role
Brick Partners provides bilingual real estate concierge services for buyers, sellers, and investors in the Miami market, including personalized property strategy, showing coordination, lender coordination, and related advisory support.
When we collect information about our own website visitors and clients, we act as the controller of that information. Where we coordinate with lenders, brokers, or other partners on your behalf, we do so at your direction and subject to their own privacy practices.
2. Information We Collect
Information you provide to us: contact details such as your name, phone number, and any details you submit through our appointment forms, requests, or communications with us — including your goals, timeline, and budget preferences.
Information collected automatically: device and usage data such as IP address, browser type, pages viewed, and referring URLs, along with cookies and similar tracking technologies (see our Cookie Policy).
Information from other sources: information from MLS and listing sources, public records, lenders, and marketing or analytics providers we use to deliver our services.
3. How We Use Information
Provide, operate, maintain, and improve the Website and our services.
Schedule appointments and showings, prepare personalized property strategies, and follow up on your requests.
Communicate with you about your appointments, transactions, and service updates.
Send marketing communications where permitted, from which you may opt out at any time.
Monitor, secure, and troubleshoot the Website, and detect and prevent fraud or abuse.
Comply with legal obligations and enforce our Terms and agreements.
4. Calls and Text Messages
If you provide your phone number or consent to be contacted, we may contact you by telephone call and SMS/text message, subject to applicable law, including the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (Fla. Stat. § 501.059).
SMS program details: message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts at any time; reply HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of any purchase.
Mobile information collected for our text messaging program is not sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
Call recording: calls may be monitored or recorded for quality, training, and compliance. Florida is an all-party consent state for recording under Fla. Stat. Chapter 934, and we handle any recording in accordance with applicable law.
5. How We Share Information
We do not sell personal information for money. We may share personal information with: service providers that host our systems, send communications, and provide CRM, analytics, and telephony services, under contracts that limit their use of the information; partners such as lenders, brokers, or title providers where you ask us to coordinate with them; legal and safety recipients when required by law, subpoena, or legal process, or to protect rights, property, or safety; and successors in connection with a merger, acquisition, financing, or sale of assets.
Mobile opt-in and text-messaging consent information is not shared with third parties for their own marketing purposes.
6. Cookies and Tracking Technologies
We and our providers use cookies, pixels, and similar technologies to operate the Website, remember preferences, measure performance, and support marketing. You can manage cookies through your browser settings, and some features may not function properly if cookies are disabled. We honor recognized opt-out preference signals where required by law. See our Cookie Policy for details.
7. Data Retention
We retain personal information for as long as necessary to provide the services, maintain business records, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it is held. When information is no longer needed, we take reasonable steps to delete or de-identify it.
8. Data Security and Breach Notification
We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
In the event of a confirmed security breach involving personal information, we will notify affected individuals and any regulators as required by applicable law, including Florida's Information Protection Act (Fla. Stat. § 501.171), without undue delay.
9. Your Privacy Rights and Choices
Marketing and communications: you may opt out of marketing emails using the unsubscribe link, and opt out of texts by replying STOP. Transactional and service messages necessary to administer your appointments may continue.
Access and deletion: depending on your state of residence, you may have the right to request access to, correction of, deletion of, or a copy of the personal information we hold about you, and to opt out of certain processing. To exercise these rights, contact us through our contact page or by phone. We will verify your request and respond as required by applicable law, and we will not discriminate against you for exercising your rights.
10. Third-Party Websites and Services
The Website and our services may link to or integrate with third-party websites, listing platforms, lenders, and messaging or scheduling platforms. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.
11. Children's Privacy
The Website and our services are intended for adults and are not directed to children under the age of 18. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, please contact us so we can delete it.
12. SMS Terms
We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes.
You can cancel the SMS service at any time by texting STOP. After you send STOP, we will send you an SMS message to confirm that you have been unsubscribed, and you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time.
If you are experiencing issues with the messaging program, reply with the keyword HELP for assistance. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply for any messages sent to you from us and to us from you, and message frequency may vary.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last Updated” date above and, where appropriate, provide additional notice. Your continued use of the Website or services after changes take effect constitutes acceptance of the revised Policy.
